The Cannabis Administration Opportunity Act 2021 – Federal Marijuana Legalization Update – 7/14/21
The bill that was mentioned yesterday (July 13th, 2021) has had its details released today! The Cannabis Administration Opportunity Act 2021 will seek to de-schedule marijuana on a federal level while preserving the authority of the states, which basically means that it’s not automatic legalization across the board. This act also seeks to expunge criminal records relating to cannabis crimes, including collateral consequences, for example having to leave the country and despite following the rules and taking the steps to come back to the country, not being able to due to cannabis crimes in the person’s record, or having your children taken away due to cannabis crime. There is a lot to know about this bill, and it stands to note that this bill is up for negotiation, so you may or may not see one of the sections of it pass.
New Jersey has decriminalized marijuana, and this year they have expunged 3,000 records so far for cannabis crimes. These were active cases or new. The New Jersey courts state that they have over 360,000 more cases that are currently incarcerated, have been, or are up for expungement that they are hoping to clear soon.
