A medical association focused on combatting drug addiction that has historically resisted marijuana reform efforts and aligned itself with prohibitionists has adopted a new policy position in favor of protecting people who use cannabis in compliance with state laws from being punished by the federal government. It’s also backing the rescheduling of medical marijuana.

The new statement makes several recommendations regarding cannabis used for medical purposes, including:

• Cannabis used for medical purposes should be rescheduled from Schedule 1 of the Controlled Substances Act to promote more clinical research and Food and Drug Administration (FDA) oversight.

New Jersey ‘Can’t Fail’ At Marijuana Legalization, Governor Says At Fundraiser For Referendum Campaign
In any case, if polling is any indication, it appears that voters are poised to pass the cannabis referendum on their ballots next month.

A survey released on Tuesday found that that 65 percent of New Jersey voters are in favor of the marijuana referendum. Just 29 percent are opposed to the policy change and six percent remain undecided.

For his part, Gov. Phil Murphy (D) has been actively campaigning in favor of the referendum, participating in fundraisers and ads to encourage voters to approve it.

The results are statistically consistent with three prior polls from the same firm, as well as one from Fairleigh Dickinson University, which similarly found roughly two to one support for the measure. A separate survey released last week by Stockton University showed three to one support for legalizing cannabis among New Jersey voters.

National Cannabis Industry Association Urges DEA to Rescind Interim Hemp Rule

The National Cannabis Industry Association (NCIA) submitted comments to the Drug Enforcement Administration (DEA)NCIA is urging the DEA to immediately rescind an interim final rule (IFR) initially published by the federal agency in August.  The assertion is that this rule is in direct conflict with the hemp provisions of the Agricultural Improvement Act (AIA) of 2018, known as the Farm Bill, and circumvents the rulemaking process required by the Administrative Procedure Act (APA)

“With this rule, the DEA is trying to overstep its bounds and exert control over a legal agricultural commodity that is no longer under its jurisdiction,” said Aaron Smith, co-founder and chief executive officer of the National Cannabis Industry Association. “Given this agency’s history of doing everything in its power to maintain the criminalization of cannabis in any form, this rule was clearly not proposed to help the thousands of small farmers who are participating in approved hemp programs and could put them in unnecessary danger. Failure to rescind it immediately is a clear violation of congressional intent and established law.”
